How are they going to prove I was texting? What if I am using the GPS feature on my phone or taking a call? Neither of those are illegal. They would have to get a search warrant from my mobile provider to prove that I actually sent a text at the time they said it occurred. Seems like a waste of time and resources. I also agree with Howard. Why does a cop need to be texting? Dont they have something called a radio that they can use to talk to dispatch?
